The website is operated by Total Prepare Inc. References in these Terms to “Total Prepare,” “we,” “us” and “our” mean Total Prepare Inc. References to “you” and “your” mean the person accessing the website, placing an order or otherwise using our services. 

By accessing or using the website, creating an account or placing an order, you agree to these Terms of Service and the policies incorporated into them by reference. 

Purchases made through the website are also governed by our:

We may suspend, restrict or close an account where we reasonably believe it:

However, information supplied by manufacturers, distributors or other providers may change. Packaging, product appearance and minor specifications may differ from website images or descriptions where the difference does not materially alter the product. 

Colours and appearance may also vary depending on your device and display settings. 

Please contact us before ordering if a particular dimension, ingredient, certification, feature, component or compatibility requirement is essential to your intended use. 

Nothing in this section permits Total Prepare to provide false or misleading product information or limits rights available to you under applicable law. 

7. Total Prepare Kits and Curated Solutions 

Total Prepare develops and assembles emergency kits and other preparedness solutions using components selected from various manufacturers and suppliers. 

Kit contents are selected based on factors that may include: 

  • Intended application 

  • Product quality 

  • Availability 

  • Regulatory or industry requirements 

  • Shelf life 

  • Portability 

  • Practical usability 

  • Customer requirements 

  • Price and overall value 

Individual components may have their own: 

  • Instructions 

  • Warnings 

  • Specifications 

  • Certifications 

  • Expiry or best-before dates 

  • Storage requirements 

  • Manufacturer warranties 

Where permitted by law and where the change does not materially reduce the function or value of the kit, we may replace an unavailable kit component with a reasonably comparable component. 

If a proposed substitution would materially affect the nature, function or value of the kit, we will seek your approval or offer another appropriate resolution before fulfilling the affected portion of the order. 

Kit photographs are illustrative. The current written contents list shown on the product page or provided in a quote should be used to confirm included components. 

8. Shelf Life, Best-Before Dates and Storage 

Shelf-life statements are based on information available from the product manufacturer, supplier, testing information or other supporting documentation. 

Unless expressly stated otherwise, a stated shelf life generally assumes that: 

  • The product remains unopened 

  • The original packaging remains intact 

  • The product is stored according to its instructions 

  • The product is protected from excessive heat, cold, moisture, sunlight, contamination and physical damage 

  • The product is not subjected to conditions outside the manufacturer’s recommended range 

Actual product life may be affected by storage and handling conditions. 

A shelf-life statement does not necessarily mean that every unit supplied will have the entire advertised product life remaining at the date of purchase. Where relevant, the product page, quote or written agreement may specify a minimum remaining shelf life at shipment. 

Customers are responsible for: 

  • Following storage instructions 

  • Inspecting packaging periodically 

  • Monitoring expiry and best-before dates 

  • Rotating stored supplies 

  • Replacing expired, opened, damaged or compromised products 

Contact us before purchasing if a specific remaining shelf life is required for an institutional, procurement or operational standard.

Nothing in this section limits obligations arising from specific written representations made by Total Prepare or rights available under applicable law.

You are responsible for reading and following all:

  • Warnings 

  • Storage requirements 

  • Maintenance requirements 

  • Manufacturer recommendations 

  • Applicable laws and regulations 

Products must be used only for their intended purposes. 

Some products may require special handling, installation, training, adult supervision or compliance with local rules. You are responsible for determining whether a product is suitable and lawful for your intended location and use. 

Do not use a product that appears damaged, contaminated, expired, recalled or otherwise unsafe. 

Contact us or the manufacturer if you have questions about product safety, instructions, maintenance or suitability. 

11. Medical and First-Aid Products 

First-aid products and related educational content are not a substitute for professional medical advice, diagnosis or treatment. 

Customers are responsible for: 

  • Obtaining appropriate medical guidance 

  • Ensuring users have suitable training where required 

  • Reviewing kit contents and expiry dates 

  • Confirming that products are appropriate for the intended workplace, facility, jurisdiction or risk 

  • Meeting applicable occupational health and safety requirements 

Call emergency services or seek qualified medical assistance when circumstances require it. 

12. Prices and Currency 

Unless otherwise stated: 

  • Prices are displayed in Canadian dollars 

  • Applicable taxes are calculated during checkout 

  • Shipping and delivery charges are additional 

  • Customs charges do not apply to standard Canadian domestic orders 

  • Discounts are applied according to the terms of the applicable offer 

  • Promotional codes cannot be combined unless expressly stated 

  • Prices may differ between retail, organizational, contract and custom-quoted sales 

We may change prices prospectively without notice. A price change will not alter an order that has already been accepted, except where permitted by applicable law or agreed with the customer. 

We make reasonable efforts to ensure pricing is accurate. If we identify an apparent pricing, description or system error before an order has been accepted, we may contact you to confirm whether you wish to proceed on corrected terms. 

Our ability to decline or cancel an order because of an error is subject to applicable consumer-protection law. 

13. Promotions, Discounts and Free Shipping 

Promotions, discount codes, bundles, gifts with purchase and free-shipping offers may be governed by additional terms displayed with the offer. 

Unless otherwise stated: 

  • Promotions apply only during the advertised period 

  • Promotions apply only to eligible products and customers 

  • Discounts are applied before taxes 

  • Promotional codes have no cash value 

  • Promotional codes cannot be applied retroactively 

  • Offers cannot be combined 

  • Product and quantity limits may apply 

  • Returns may reduce or eliminate the value of a promotional benefit 

  • A promotion may end when allocated inventory is exhausted, where clearly disclosed

If promotional wording conflicts with these Terms, the specific terms displayed with the promotion will govern that promotion, subject to applicable law. 

14. Placing an Order 

Before submitting an order, you will have an opportunity to review information such as: 

  • Products and quantities 

  • Prices 

  • Discounts 

  • Applicable taxes 

  • Shipping charges 

  • Billing information 

  • Delivery information 

  • Payment information 

  • Applicable policies 

You are responsible for reviewing and correcting errors before submitting the order. 

By submitting an order, you are offering to purchase the selected products on the terms presented during checkout. 

An automated order confirmation generally confirms that we received your order. It does not necessarily mean that the order has been accepted or that every item is available. 

Subject to applicable law, an order may be accepted after we have completed relevant steps such as: 

  • Confirming inventory 

  • Authorizing payment 

  • Reviewing delivery restrictions 

  • Completing fraud and security screening 

  • Verifying account or order information 

 We ordinarily accept an order when payment is captured and inventory is allocated. 

Once an order has been accepted, we will cancel or modify it only as permitted by applicable law or with your agreement. 

15. Order Review, Refusal and Cancellation 

Before an order is accepted, and subject to applicable law, we may decline or request additional information concerning an order where: 

  • Payment cannot be authorized 

  • Required information is incomplete or inaccurate 

  • The product cannot lawfully or safely be delivered to the destination 

  • The order appears fraudulent or unauthorized 

  • The order violates stated product or promotional limits 

  • The order appears to be placed for unauthorized resale 

  • The order would violate law, sanctions or carrier restrictions 

  • A material website error is identified 

  • Inventory cannot be reasonably confirmed 

If we decline an order after payment has been authorized or collected, we will void the authorization or issue an appropriate refund. 

After an order has been accepted, inventory shortages, supplier issues or fulfilment problems will be handled in accordance with applicable law. Depending on the circumstances, we may offer: 

  • A revised delivery date 

  • A backorder 

  • An approved substitution 

  • Partial fulfilment 

  • A refund for the unavailable portion 

  • Cancellation by agreement 

Nothing in these Terms gives Total Prepare an unrestricted right to cancel a completed consumer contract where cancellation is prohibited by law. 

16. Quantity Limits and Resale 

We may establish reasonable limits on the quantity of products purchased: 

  • Per customer 

  • Per household 

  • Per organization 

  • Per account 

  • Per payment method 

  • Per delivery address 

  • During a promotion or supply shortage 

Limits will be communicated where reasonably practicable. 

Retail pricing and promotions are intended for end users unless otherwise stated. Customers seeking products for resale, redistribution, large-scale deployment or institutional use should contact our Corporate Solutions team.

We may decline orders that reasonably appear intended for unauthorized resale, diversion, export or abuse of retail promotions, subject to applicable law. 

17. Payment 

You agree to provide current, complete and accurate payment and billing information. 

Payments are processed by Shopify Payments. Your use of a payment option may also be subject to the payment provider’s terms. 

By submitting payment information, you represent that: 

  • You are authorized to use the payment method 

  • The information provided is accurate 

  • Charges associated with the order may be processed 

  • Any applicable taxes, shipping charges and other disclosed amounts may be collected 

Payment authorization does not necessarily mean the order has been accepted. 

We may use fraud-prevention and payment-verification services. We may contact you or request reasonable verification before accepting or fulfilling an order. 

We will not request complete payment-card details by ordinary email. 

18. Organizational, Institutional and Custom Orders 

Orders placed by businesses, government bodies, schools, healthcare organizations, non-profit organizations, Indigenous communities and other institutional customers may be subject to: 

  • A written quotation 

  • A purchase order 

  • Credit approval 

  • Deposit requirements 

  • Custom payment terms 

  • Minimum order quantities 

  • Product substitutions 

  • Delivery schedules 

  • Project-specific specifications 

  • Special shipping arrangements 

  • Separate contractual terms 

Where a written quote, purchase agreement or other signed contract conflicts with these website Terms, the specifically negotiated written agreement will govern to the extent of the conflict. 

Unless otherwise stated in writing, quotes: 

  • Are valid for 30 days 

  • Are subject to inventory availability 

  • Are based on the stated quantities and delivery assumptions 

  • Exclude taxes and shipping unless included 

  • May require revision if scope, quantities, destination or timing changes 

Custom-built, specially sourced, branded or made-to-order products may have separate cancellation and return restrictions that will be disclosed before the order is finalized. 

19. Shipping and Delivery 

Shipping, delivery, pickup, processing times, free-shipping eligibility, destination restrictions and freight procedures are governed by our Shipping & Delivery Policy. 

Delivery dates and transit times are estimates unless we expressly agree in writing to a guaranteed date. 

Events outside our reasonable control may affect fulfilment or delivery, including: 

  • Severe weather 

  • Wildfires, floods or other emergencies 

  • Carrier delays 

  • Labour disruptions 

  • Supply interruptions 

  • Border or transportation restrictions 

  • Government action 

  • Power, telecommunications or system failures 

We will take reasonable steps to communicate significant delays and provide remedies required by applicable law. 

Risk of loss, responsibility for delivery and title to goods will be determined in accordance with applicable law and the shipping terms disclosed for the order. 

20. Returns, Refunds and Cancellations 

Returns, refunds, exchanges, damaged shipments, defective products and customer-requested cancellations are governed by our Returns, Refunds & Cancellations Policy. 

That policy includes information concerning: 

  • Return eligibility 

  • Return time limits 

  • Product condition 

  • Non-returnable products 

  • Food, water and consumable products 

  • Final-sale and clearance products 

  • Return authorization

21. Product Warranties 

Some products may be covered by a warranty offered by the manufacturer, distributor or Total Prepare. 

The applicable product page, packaging, warranty document or manufacturer documentation will describe any additional written warranty. 

Manufacturer warranties may require the customer to: 

  • Retain proof of purchase 

  • Register the product 

  • Contact the manufacturer directly 

  • Follow maintenance instructions 

  • Submit photographs or other supporting information 

  • Return the product for inspection 

We will provide reasonable assistance in identifying applicable warranty information where available. 

Additional written warranties do not replace legal warranties or statutory rights that apply automatically under applicable law. 

We do not make a warranty or guarantee unless it is expressly stated in writing or required by law. 

22. Product Recalls and Safety Notices 

If we become aware of a relevant product recall or material safety notice, we may take steps such as:

  • Contacting identifiable affected customers 

  • Suspending sales

  • Coordinating a return, repair, replacement or refund

Recall remedies will be handled according to applicable law and the instructions of the responsible manufacturer or regulatory authority.

“Total Prepare” and associated logos and branding are trademarks or trade names of Total Prepare Inc. 

26. Reviews and User Submissions 

You may be able to submit reviews, feedback, photographs, questions or other content. 

You retain ownership of content you submit. By submitting content for public display, you grant Total Prepare a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display that content for the purposes for which it was submitted, including promoting the reviewed product or our business. 

This licence ends when the content is removed from our active systems, except where continued retention is legally required or the content has already been incorporated into materials that cannot reasonably be withdrawn. 

You represent that: 

  • You created the content or have permission to submit it 

  • The content reflects your genuine experience or opinion 

  • The content does not infringe another person’s rights 

  • The content is not unlawful, defamatory, deceptive or abusive 

  • The content does not contain confidential or sensitive personal information 

We may moderate or remove content that violates these Terms, is unrelated to the product or service, exposes personal information, contains spam or creates legal or security concerns. 

We will not restrict or penalize a customer merely for posting an honest review or expressing a genuine negative opinion. 

27. Third-Party Services and Links 

The website may contain or rely on services provided by third parties, including:

30. Disclaimers

31. Limitation of Liability 

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law. 

Subject to that restriction, Total Prepare will not be liable for indirect, incidental, special or consequential loss arising solely from: 

  • Website downtime 

  • A third-party website or service outside our control 

  • Customer misuse of a product 

  • Failure to follow product instructions or storage requirements 

  • Unauthorized access caused by a customer’s failure to protect account credentials 

  • Reliance on general educational information instead of professional or official guidance 

Where liability can lawfully be limited, Total Prepare’s aggregate liability relating to a particular purchase will not exceed the amount paid for the product or service giving rise to the claim. 

This limitation does not apply to: 

  • Death or personal injury caused by negligence where liability cannot be excluded 

  • Fraud or intentional misconduct 

  • Gross negligence where limitation is prohibited 

  • Breach of mandatory consumer rights 

  • Product liability that cannot be excluded 

  • Privacy obligations that cannot be limited 

  • Any other liability that applicable law does not permit us to limit 

32. Events Outside Our Reasonable Control 

We will not be responsible for a failure or delay caused by an event outside our reasonable control, provided that we take reasonable steps to reduce the effect of the event and comply with applicable law. 

Such events may include: 

  • Natural disasters 

  • Wildfires and floods 

  • Severe weather 

  • Public emergencies 

  • Epidemics or pandemics 

  • Labour disruptions 

  • Transportation or carrier interruptions 

  • Supplier failures 

  • Government restrictions 

  • Utility or telecommunications failures 

  • Cybersecurity incidents affecting third-party infrastructure 

This section does not remove any right to cancel, receive a refund or pursue another remedy that you have under applicable law. 

33. Governing Law 

These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada. 

However, this choice of law does not deprive a consumer of mandatory rights or protections available under the laws of the province or territory in which the consumer resides. 

The courts located in British Columbia will have jurisdiction over disputes, except where applicable consumer-protection law permits or requires a dispute to be brought elsewhere. 

Nothing in these Terms requires a consumer to submit a dispute to binding arbitration or waive participation in a class proceeding where such a requirement or waiver is prohibited by law. 

34. Resolving Concerns 

Please contact us before starting formal proceedings so that we have an opportunity to review and resolve the concern. 

When contacting us, please provide: 

  • Your name and contact information 

  • Your order or quote number 

  • The product or service involved 

  • A description of the concern 

  • The resolution you are requesting 

  • Relevant photographs or documents 

Contacting us does not suspend or waive any legal limitation period unless we agree otherwise in writing or applicable law provides otherwise. 

Nothing in this section prevents you from contacting a consumer-protection authority, privacy regulator, court or other body with jurisdiction over the matter. 

35. Severability 

If any part of these Terms is found to be unlawful, invalid or unenforceable, that part will be interpreted or limited to the minimum extent necessary. 

The remaining portions will continue in effect unless the invalid provision is so fundamental that the Terms cannot reasonably operate without it. 

36. No Waiver 

If we do not immediately enforce a provision of these Terms, that does not mean we waive the provision or our ability to enforce it later. 

A waiver is effective only if it is made in writing by an authorized representative of Total Prepare. 

37. Assignment 

You may not transfer your rights or obligations under these Terms without our written consent. 

We may transfer our rights and obligations as part of a merger, reorganization, financing, sale of the business or transfer of relevant assets, subject to applicable law and without reducing rights relating to an existing consumer purchase. 

38. Entire Agreement and Order of Precedence 

These Terms, together with the policies and transaction information incorporated by reference, form the agreement between you and Total Prepare concerning use of the website and purchases through it. 

For a particular transaction, the following order of precedence applies where documents conflict: 

  1. A separately negotiated and signed written agreement 

  1. A final written quotation accepted by the customer 

  1. Product-specific or promotion-specific terms disclosed before purchase 

  1. Information presented during checkout 

  1. The Shipping & Delivery Policy 

  1. The Returns, Refunds & Cancellations Policy 

  1. These Terms of Service
